Adam Epstein, a partner in Mishcon de Reya's Finance & Banking Group, recently took part in a high-level panel discussion centred around the new Senior Management Regime, as part of Legal Week's inaugural Banking Litigation & Regulation Forum in London. The debate, held on 10 June 2015, focused on the implications of the new regime. Adam highlighted the importance of senior managers within the relevant firms having access to independent legal advice.
"Senior managers need to be absolutely sure that they are properly equipped to discharge their new responsibilities," he said. "They also need to be very clear on what their liabilities are if they fail to discharge them. There are a number of areas in which there are likely to be issues between senior managers and their firms down the line if the individuals have not properly addressed their positions. What this means is that it is also in the interests of firms to ensure that independent advice is made available to them as it is likely to strengthen their position should future issues arise."
Adam was joined on the panel by Michael Plumbridge, head of regulatory change at ICBC Standard Bank, along with partners at various City law firms.
