  • Environmental and Social Governance (ESG)

Critical to decarbonisation, the energy transition also depends heavily on rare earth minerals and metals, which are often concentrated in ecologically sensitive regions and on indigenous lands.

Illustrating the complex nexus of environmental, social and geopolitical challenges, this underscores the need for expert advice that integrates regulatory compliance with strategic foresight and anticipatory risk management.

Mishcon Purpose, the firm's specialist ESG and sustainability practice, addresses this need by combining expert lawyers and sustainability professionals, helping clients both to meet current obligations and build future resilience.

We advise corporates and private interests on evolving legal, physical and transition risks, and the development and implementation of strategy and governance frameworks to address them.

We have unique experience and expertise in biodiversity, including nature positive and restoration planning, as well supporting development of credible, scalable credits markets.

Committed to amplifying the role of the law in accelerating transformative change, we also chair the Sustainable Markets Initiative's Legal Taskforce, and play a leading role in legal sector initiatives such as the Legal Charter 1.5 and the Greener Litigation Pledge.

The transition to sustainable infrastructure will be the impetus for a new wave of project financings. This includes emerging areas such as batteries, electric vehicles, energy conversion plants, energy-from-waste, biomass, hydrogen, wind and solar power and carbon capture and the supply and processing of critical minerals such as lithium, nickel, copper, cobalt and vanadium.

Our project finance team has extensive experience in structuring ventures and in project implementation. We have significant experience in the mining sector and related downstream enterprises. Our advice covers the entire mine life cycle and relies on our deep understanding of equity and debt capital markets and of restructurings. In a world of increased public and regulatory scrutiny, all businesses – and their senior employees - are vulnerable to reputational attack. Energy and resources companies have the significant, added concern of managing their environmental impact. This includes the reputational risks of inaction as well as missteps or perceived missteps, and allegations of greenwashing. Our reputation lawyers are experts in all aspects of crisis management – from viral smear campaigns to leaked private information – as well as proactive reputation protection. They help to strengthen clients against future attack, addressing latent reputational risks, scanning the horizon and implementing robust crisis protocols.

Guides
  • A guide to safeguarding your business against Greenwashing risks

Greenwashing, the practice of overstating the environmental benefits of products or practices, poses a significant challenge to achieving genuine sustainability.   Alarmingly prevalent, a recent Which? study revealed that 84% of 1,000 products with green claims in the UK failed to meet at least one principle of the UK Green Claims Code. Whether intentional or accidental, the repercussions of greenwashing are severe: reputational damage, hindered progress towards sustainability, and potential legal liabilities.
