Discussions have begun between the EU and US for an "enhanced" Privacy Shield. In a recent joint statement, the European Commission and the US Department of Commerce said they are evaluating the potential to revise the Privacy Shield framework to comply with the European Court of Justice’s Schrems II ruling, which invalidated the mechanism for data transfers between the US and the bloc.
Speaking on the matter in Global Data Review, Partner Adam Rose said: “The big US data companies will be lobbying both the US and EU governments hard for a deal. Without one, EU businesses will be reticent about trading with them.”
“But the privacy lobby in the EU will be looking to stand firm on this issue – data protection is fundamental to the European psyche and human rights law.”
