Divorce law post Brexit: breaking up is never easy

Barbara Reeves discussed the potential impact of Brexit on UK family law in her article for eprivateclient.

'What is clear is that the revocation of swathes of EU legislation regulating the pan European approach to marital law is likely to have a major impact on domestic UK family law delivery and, in particular, on the 3.7 million EU citizens who currently live in the UK and 1.5 million British citizens living in the rest of the EU. Similarly, decisions in relation to other matrimonial issues such as maintenance payments made in one EU member state, which are currently recognised and enforced in other EU member states without needing to invoke any specific domestic procedure, will need to be addressed also.'

In Barbara's words, 'Without a common approach, any cross jurisdictional EU divorce is likely to involve lengthy and costly disputes.'
