Welcome to our first newsletter of 2022, in which we look at the legal issues that are currently shaping the recruitment sector.

In this edition, our immigration team discusses the upcoming changes to digital right-to-work checks for candidates and announces the closure of Tier 1 (Investor) visa applications. Following the chaos caused by security breaches at umbrella companies, which delayed the payment of thousands of contractors, our data protection team provides a brief guide on the rise of cyber-attacks and outlines Hub Plus, which combines a platform designed to help you keep on top of your data protection responsibilities with guided assistance from a dedicated Mishcon de Reya data expert.

We also discuss holiday pay and the right to carry over indefinitely when workers take unpaid leave, recent developments on the right of agency workers to be notified about job vacancies with the hirer they are on assignment with, the benefits of using Statements of Work and the interplay with IR35, and the viability of employee ownership structures for recruitment companies.

Our new segment on major transactions in the recruitment sector looks at the sale of Nolan Partners, a globally recognised sports, entertainment and media senior executive and board level search firm to Excel Sports Management.

Finally, like so many others, we have watched with despair as the people of Ukraine have been devastated by the events in recent weeks. We have donated to a number of organisations including UNHCR and the Red Cross. The firm has also partnered with leading organisations to create the Ukraine Justice Alliance.
