Kathryn Garbett and Mehmet Karagoz have written an article for the New Law Journal on the findings in Willers v Joyce & Nugent, which considered a claim for malicious prosecution of a civil claim.
They said; "A claim for malicious prosecution of a civil claim is likely to be difficult and will require considerable resource to investigate and pursue through to trial. Nevertheless, the cause of action is legally recognised and can, and no doubt will, be pursued in the right circumstances."
