Anaar Patel is an Associate in the Intellectual Property department. Anaar specialises in IP litigation, and advises clients on the contentious protection and enforcement of all IP rights, including trade marks, passing off, design rights, copyright, patents, database rights, confidential information and trade secrets.
She acts for a wide range of clients with a particular focus on those in the retail, technology, pharmaceutical, fashion, FMCG, media and food and beverage sectors. Anaar has represented clients in disputes in the High Court, Court of Appeal and Supreme Court, and before the UK and EU Intellectual Property Offices, General Court and Court of Justice of the European Union, and in alternative dispute resolution procedures including mediations.
Anaar represents numerous clients in trade mark infringement and cancellation disputes in the English Courts, including advising a leading global online retailer in an infringement claim that went up to the Court of Appeal, and the associated breach of settlement proceedings. She also regularly acts for leading technology firms in counterfeit and parallel imports claims, including obtaining Search and Freezing Orders. As well as traditional litigation fora, Anaar also advises on Customs and Trading Standards detentions and enforcement for many clients in the fashion and luxury sectors.
In the patent world, Anaar acts in infringement and validity disputes, and utilises her considerable commercial litigation experience to advise on claims to recover damages in patent proceedings (for example, acting for Dr Reddy's Laboratories in its ongoing damages inquiry following Warner-Lambert's unsuccessful second medical use patent infringement claim relating to its pregabalin drug). Anaar also represents clients in disputes concerning the scope of protection of Supplementary Protection Certificates (SPCs); this includes acting for Lupin in its successful application to revoke Gilead's SPC for the HIV treatment Truvada® following hearings before the Grand Chamber of the Court of Justice of the EU and the Court of Appeal in London.
Additionally, Anaar has substantial experience in civil fraud, economic tort and commercial claims, as well as non-contentious matters, including advising clients on all aspects of their brand protection and exploitation, commercial and transactional IP matters and multi-jurisdictional trade mark clearance and portfolio management.
Anaar is ranked as a Rising Star by IP Stars in 2020, and is a member of the Intellectual Property Society (IPSoc) and CEW (Cosmetics Executive Women) network.
