Experts from our Private Commercial Litigation and Reputation Protection teams navigated the multitude of challenges and disputes which can arise within family businesses, invasion by the media and managing the reputational fallout of bust-ups.

Working through an interactive case study and open discussion, the session emphasised the need for holistic and strategic legal, reputation and privacy protection measures in addressing a broad range of disputes, including how and when to collaborate with Public Relations advisors and Cyber Forensic experts and the importance of creative problem solving when dealing with the conflict inside and outside of family businesses.

Experts from our Art Law, Modern Families and Private Wealth Disputes teams looked at how careful planning can minimise risk of dispute and maximise the enjoyment and financial benefit of purchasing, inheriting, and how best to transfer to the next generation art and luxury assets.

These days families encompass a wide range of relationships and are not necessarily nuclear in nature. Step-children, un-married partners, same-sex marriages, children born by surrogacy and/or using donated gametes are now (thankfully) common – but the law has not always caught up. This means that early advice and planning is essential, not least if creators and settlors of wealth (including art and luxury assets) want to ensure that the family members they want to benefit actually do.

It is not just the meaning of ‘family’ that has moved on – but also the concepts of art and luxury assets. High net worth individuals don’t necessarily just invest in (and enjoy) old masters these days – graffiti art, dinosaur fossils, photographs, handbags, and NFTs are just some examples of modern art that is invested in and enjoyed. The acquisition of these assets can, however, be beset with pitfalls, as can their ownership on death or divorce.
