Welcome to the autumn edition of Brand Matters. In this issue, we take a close look at enforcement — how brand owners are pursuing infringers and the online platforms they use, what remedies the courts are willing to award, and how new regulatory tools are reshaping the landscape.

Last week, it was a pleasure to welcome many of our clients, contacts and friends to our Style Gallery event. One of the highlights of the Mishcon calendar, the event saw our client lounge transformed into a vibrant showcase of standout brands. Thank you also to each of the brands for joining us. Shein v Temu: High Court declines to find platform liability for copyright infringement

In a copyright battle between two major fast fashion platforms, the High Court has dismissed all of Shein's copyright infringement claims against Temu, holding that Temu did not commit any acts of copyright infringement (nor authorise any acts) in relation to product listing photographs uploaded to the Temu UK website by third party merchants.
