In this session our Commercial Partner, Adam Rose will be speaking on Good Faith in Commercial Contracts.
Whilst there is no general obligation under English law to negotiate or perform a contract in good faith, the Courts are increasingly stepping in to deal with situations of perceived unfairness in commercial arrangements. With the law on this issue evolving, Adam will consider a number of issues including interpretation of express good faith clauses, the circumstances in which a good faith clause may be implied into a contract, and what exactly constitutes 'good faith'. As well as providing an overview of developments in this area, Adam will suggest practical solutions for commercial parties.
