Following last week’s inclusion in the Top 20 Cases of 2020, two more Mishcon cases have featured in The Lawyer’s round-up of the Top 15 Appeals to Watch in 2020. Both appeals have already been heard and judgment is awaited.
The case of Asset Co Plc v Grant Thornton UK LLP is being led by Mark Davis, assisted by Eleanor Dixie and Donika Ramadani, and is likely to become a leading judgment in auditor’s negligence cases where as a result of an auditor’s breach of duty it fails to detect that a company is being run fraudulently by management. As such, it has potentially serious ramifications for the audit profession generally.
The Mastercard/Visa Interchange Fee Litigation, in which Rob Murray, Zac O’Brien and Freya Mead act for Sainsburys, saw an appeal to the Supreme Court in January. This case will establish a number of important points of competition law relating to damages actions including the assessment of two-sided markets and of the quantum of losses. The judgment will affect many current and future damages cases following on from cartel findings and other types of competition law infringements.
Mishcon acted on 10 cases in the Court of Appeal last year, and 2 cases in the Supreme Court.
