Mishcon de Reya Partner Ben Brandon was interviewed by The i newspaper on the complex legal and political challenges of extradition.
This comes in the wake of growing calls for former Brazilian president Jair Bolsonaro to be extradited from the US to Brazil, following an attack on Brazil’s Congress building by Bolsonaro's supporters.
Commenting on the situation, Ben explained: "There needs to be evidence of a crime being committed in Brazil, that is also a criminal offence in the US. [Mr Bolsonaro] would presumably deploy the arguments that are usually seen in these types of political cases – that this is politically motivated and he is being persecuted. Almost every extradition treaty has exemptions for politically motivated cases and he would seek to fall within that exemption.”
