ASA's approach to AI in advertising regulation

The  Advertising Standards Authority (ASA) has recently published an update on its approach to the use of artificial intelligence in advertising. This explains how the ASA is harnessing AI technology through its Active Ad Monitoring system to enhance the efficiency of its own surveillance of ad compliance. Alongside this, the ASA has issued a report on the use by brands of "AI" as a marketing term, providing guidance for businesses on responsible advertising practices.

IPEC rows back from EU's expansive approach to copyright

In Waterrower (UK) Limited v. Liking Limited, the Intellectual Property Enterprise Court (IPEC) analysed the leading UK judgments on applied art and handed down the first judgment which seeks to resolve the apparent divergence between UK and EU law on this issue head on. In doing so, it has taken the conversation about the role of copyright in post-Brexit UK to its next level.

UK government sets out Digital Markets, Competition and Consumers (DMCC) Act: implementation timetable update

We previously reported on the Digital Markets, Competition and Consumers (DMCC) Act when it received Royal Assent earlier this year with a focus on the consumer law implications for software and digital content providers. On 9 September 2024 the Department for Business and Trade issued a statement setting out the Government's plans for implementation of the Act's five Parts between now and spring 2026. This will be a phased implementation incorporating continuing consultation with businesses and consumers intended to allow those affected enough time to prepare.
