Welcome to our latest edition of Property Litigation Watch. 

In this issue, we spotlight the Building Safety Act 2022, highlighting a couple of discrete, interesting issues arising out of the Triathlon Court of Appeal judgment and the more recent Upper Tribunal decision concerning Centre Point House.   In our 'Speaker's Corner Q&A', Property Litigation Managing Associate Charlotte Nayler hears from Jonathan Herrick of Herrick Fire on his involvement in shaping post-Grenfell fire safety legislation and the Building Safety Act. 

In this edition's podcast, Of Counsel Knowledge Lawyer Lauren King chats to Lucian Cook, head of Savills Residential Research and one of the country's most respected housing market commentators, about the impact of the recently enacted Renters' Rights Act 2025 on the private rented sector.

Almacantar Centre Point House: Significant implications for landlords recovering historic cladding remediation costs

Almacantar Centre Point Nominee No.1 Ltd & Anor v Penelope De Valk & 12 Others UKUT 298 (LC) concerned an appeal from the First-tier Tribunal ("FTT") to the Upper Tribunal ("UT"). The appellants, the freeholders of Centre Point House ("Almacantar"), were challenging a determination by the FTT that certain leaseholders were protected from service charge liability for proposed façade remediation works.

A guide to the Renters' Rights Act 2025

The Renters’ Rights Act (“the Act”) received Royal Assent on 27 October 2025 and will be implemented in a number of phases, as set out in the government's recently published "roadmap". The Act will fundamentally overhaul the UK private rented sector, bringing several transformative changes that will reshape the relationship between residential landlords and tenants and deliver new and stronger protections for the vast majority of England's 11 million private renters.
