Private Prosecutions: Gareth Minty for the International Bar Association

The International Bar Association has written an article which explores the controversies and reforms surrounding private prosecutions in the UK. The Government is now consulting on measures such as a binding code of conduct, accreditation, and a public register for private prosecutors to ensure fairness, transparency, and accountability. Experts highlight concerns about the risk of a two-tier justice system, the need for better data, and the importance of protecting defence rights, especially for vulnerable defendants. 

Mishcon de Reya is prominently featured through Gareth Minty, Partner and Chair of the Private Prosecutors' Association. Gareth welcomes the Government’s consultation and advocates for a mandatory code of conduct to ensure private prosecutions are fair and in the public interest. He also emphasises the need for improved data collection and transparency and warns that proposed cost caps could restrict access to justice for charities and the public, while having little impact on wealthier organisations.
