Richard Stopford, Legal Director and sanctions expert at Mishcon de Reya, is quoted in Citywealth’s latest analysis of the shifting UK and US sanctions landscape.
Richard notes that recent Supreme Court decisions have set a high bar for challenging UK sanctions designations, with courts granting ministers wide discretion and public policy aims often outweighing personal property interests.
He also highlights ongoing difficulties in interpreting “ownership and control” for sanctions purposes, following the EuroChem v Société Générale and ING Bank case, and stresses the importance of robust compliance protocols for advisers.
Despite the stricter regime, Richard points out that public enforcement remains limited, suggesting a need for greater collaboration and resources to make the system more effective.
