Senior Data Protection Specialist Jon Baines wrote a piece that was published in The Times, highlighting the perils of the FOIA for private companies who do businesses with public authorities.
Jon explained: "Businesses are often unaware of the risk to their confidential information that the Freedom of Information Act 2000 presents. Historically, commercial law specialists may well have thought that the law simply is not relevant to their clients. That would be a mistake. From a commercial perspective, those companies who have failed to negotiate appropriate contractual protections might find their confidential commercial information at risk of public disclosure.”
