Filippo Noseda discusses data protection implications of FATCA and public registers of beneficial ownership in Tax Notes International

Filippo Noseda, Partner in Private Tax and Wealth Structuring team, has written the third of a series of articles for Tax Notes International, which look at the compatibility of EU public registers of beneficial ownership, and fundamental rights to privacy and data protection.

This article focuses on EU documents Filippo has obtained as part of his work with claimants and petitioners to raise awareness on the data protection implications of public registers of beneficial ownership and systems of automatic exchange of information, such as the US FATCA and the common reporting standard.

"When it comes to fundamental rights, having a debate is as important, if not more important, than the fundamental judgment, and the EU institutions’ approach in stifling an open and informed debate on the impact of mass processing of personal data in the field of taxation is a matter of grave concern that goes to the root of the EU’s democratic foundations." – writes Filippo.
