The Inside Investigations series continues with a session looking at the latest developments in corporate criminal liability which has recently undergone its biggest reforms in decades, with the introduction of the new corporate offence of failure to prevent fraud and the reform of the identification principle.
This session will review the latest reforms and also consider developments in terms of enforcement action against corporates more widely, with a view to the impact on companies and what it means for internal and external investigations.
Join Christopher Gribbin and Euan McMahon as they examine the impact of these changes, including:
- the reform of the identification principle (directing mind and will) as the basis on which companies can be held criminally liable;
- the expansion of the failure to prevent model of criminal liability; and
- what the latest corporate guidance from the SFO and CPS means for companies faced with a potentially criminal issue.
