Client survey on reform to non-compete clauses

In November 2025, the Government published a working paper proposing reforms to the law on non-compete clauses in employment contracts. The options under consideration range from an outright ban to statutory duration caps and salary-based thresholds.

The outcome will matter to every employer that relies on non-competes to protect its business.

To understand how employers view these proposals in practice, we surveyed our clients on how they currently use non-competes and their views on the Government’s suggested reforms.

Our findings send a clear message: businesses are not ready for radical change and largely consider that the current legal framework already provides sufficient safeguards. Respondents also noted that restricting non-competes could redirect investment away from the UK.
