Ben Brandon in TIME magazine on UK/US extradition

Ben Brandon, Barrister and Partner in the White Collar Crime & Investigations Group at Mishcon, was featured in last week’s ‘Royals’ section of TIME magazine, commenting on the upcoming sexual abuse lawsuit against Prince Andrew.

The claimant is among the victims of the late convicted sex offender Jeffrey Epstein, and has accused Prince Andrew of “sexual assault and battery” in 2001 on three occasions in London and New York. Prince Andrew denies the allegations.

As a specialist in extradition, Ben Brandon explains why it is unlikely that Prince Andrew would be extradited to the U.S. to face sexual assault charges, and considers whether contempt of court can be considered an extradition offence: “Any judgement debt would be in the US, and they would have to bring separate proceedings in the U.K. to enforce [it]”. He also discusses future statutory limitation risks for the Prince, and whether the case could impact the US and UK’s relationship.
