Partner Chris Neilson has provided comments to Law360 on the Commercial Court's recent decision in AerCap Ireland Limited & Ors v AIG Europe SA & Ors, a case concerning insurance claims made by aircraft leasing companies in respect of aircraft and aircraft engines which the claimants contended were lost to them following the Russian invasion of Ukraine in 2022. In a lengthy judgment, Mr Justice Butcher agreed that the aircraft had been lost and that the loss fell to the war risks cover purchased by the claimants from insurers.
In the Law360 article, Chris highlights the wider implications of the decision, particularly the confirmation of the correct legal test to determine when the deprivation of possession of property becomes permanent, such that it becomes lost for the purposes of cover under a property policy.
