Welcome to our latest edition of Recruitment Watch, in which we look at the legal issues that are currently shaping the recruitment sector.

In this edition, we highlight proposed reforms to the law on non-compete clauses, holiday pay and working time records obligations and TUPE consultation requirements for small businesses. We provide an update on employee incentives following the Spring Budget and explain how TV presenter Gary Lineker won his IR35 tax battle with HMRC.

Our data protection experts examine the Data Protection and Digital Information (No.2) Bill and the changes made following the introduction of the first Bill last year. They also comment on the UK's AI White Paper which, in contrast to the EU's rule-based approach, proposes a flexible approach to the development and use of AI through the implementation of a framework underpinned by five key principles instead of introducing legislation.

In the M&A sphere, we highlight our role in i-Resource's acquisition of workforce engagement app, Ryalto, and explore the benefits of putting ESG considerations at the heart of business planning for M&A transactions and beyond. Finally, we provide guidance on how large organisations can prepare for the new corporate offence of failure to prevent fraud, report on HMRC's investigations in connection with the corporate criminal offences of failure to prevent the facilitation of tax evasion, and reissue our article on recruitment companies and tax fraud, which remains an area for vigilance.

If you would like to discuss any of the issues raised, or there is a topic you would like us to cover in one of our future editions, please get in touch with a member of the Recruitment Services team or by contacting us.
