Daniel Levy, Partner, Head of Real Estate Disputes, Real Estate

Welcome to the winter edition of Property Litigation Watch.

In our final issue of 2023, Laura Odlind and Laura Tweedy discuss the background to the Renters (Reform) Bill, the key changes for landlords and tenants, and the timings for implementation, while Kathryn Sowter of Pelham Lease Advisory takes her turn in our 'Speaker's Corner Q&A'.

Mark Reading and Isabel Emerson-Lich provide a step-by-step guide for tenants to navigate forfeiture by re-entry, and look at how sustainability concerns can affect lease renewal provisions.

We also feature a piece from this summer, authored when The Court of Appeal handed down its judgment in the Vodafone Ltd v Potting Shed Bar & Gardens Ltd (formerly Gencomp (No7) Ltd) and AP Wireless II UK Ltd.

Finally, our 'On the horizon' piece looks ahead to key reforms and landmark cases expected across the commercial and residential property spheres in 2023.

On a separate note, we were delighted to celebrate Mark Reading's appointment to the Chair of the Property Litigation Association. In an in-depth interview with EG's Senior Deputy Legal Editor Jess Harrold, Mark shares his ambitions for the PLA, his career highlights, and his passion for representation and law reform. You can read the full interview here.

In addition to Mark's appointment to PLA Chair, Chhavie Kapoor has been appointed as inaugural Chair of the PLA's EDI committee, to promote equity, diversity and inclusion within its membership.

We hope you enjoy this issue and welcome your feedback. If there is anything in this newsletter that you wish to discuss further, or if you have ideas for our 2024 editions, please don't hesitate to contact any member of our property litigation team here.

Wishing you all a wonderful festive December with family and friends, and we look forward to seeing you again in the new year.
