Partner Karen Sanig on BBC Radio 4's Front Row

On Monday 19th January Karen Sanig, Partner and Head of Art Law, featured on BBC Radio 4's flagship culture programme Front Row discussing Mr Lancelot Thwaytes v Sotheby's [2015] EWHC 36 (Ch) a decision of Mrs Justice Rose, handed down on 16 January 2015.

The case was about the alleged negligence of Sotheby's in their attribution of an old master painting. The former owner of 'The Cardsharps' a painting now thought to be by Caravaggio and valued at around £10million, lost his battle for compensation from Sotheby’s –  who had sold it on his behalf for £42,000 in 2006. Sotheby's had catalogued the work as "follower of Michelangelo Merisi Da Caravaggio" and described it as a 17th Century copy of the original in the Kimbell museum in Texas. Throughout the case Sotheby's maintained that this was the correct attribution.

The programme description reads: "Sotheby's has been cleared of negligence over the attribution of a painting claimed to be by Caravaggio, so John seeks advice from Karen Sanig, Head of Art Law at solicitors Mishcon de Reya about what you might do if a work by a certain artist that you have bought turns out not to be, and the complications arising."
