This talk introduces the core principles of judicial review and its application for both private individuals and commercial organisations seeking to protect their interests, including against perceived Government/public body overreach or misunderstanding. Where there is a concern that the Government and/or public body has reached a decision without a proper understanding of the industry and/or the ramifications of a change to legislation or a particular decision, a judicial review challenge (or the threat thereof) is an effective way of addressing such concerns.
The session will cover the grounds on which public decisions can be challenged, the process for bringing a claim, and the remedies available. The session will highlight key cases (from the prorogation of Parliament to the protection of pigeons), explain the limits of judicial intervention, and offer practical guidance for those considering review proceedings.
