Thinking of getting divorced in the UK?

How do I get divorced here/can I get divorced here?

In essence, you can divorce in England if you both lived here prior to the separation and one of you is still living here, or if you have been living here for at least 12 months (reducing to six months if you are also domiciled here) prior to initiating divorce proceedings. The concepts of ‘habitual residence’ and ‘domicile’ are different to those used for tax purposes and focus more on your centre of interest and where you consider yourself to be from. As such a divorce can also take place here if both parties are domiciled here.

Comment puis-je divorcer ici/puis-je divorcer ici ?

En substance, vous pouvez divorcer en Angleterre si vous viviez tous les deux ici avant la séparation et que l’un de vous y vit toujours, ou si vous y avez vécu pendant au moins 12 mois (ce délai étant réduit à six mois si vous êtes également domicilié ici) avant d’entamer la procédure de divorce. Les concepts de résidence habituelle et de domicile sont différents de ceux utilisés à des fins fiscales et mettent davantage l’accent sur vos centres d’intérêts et sur l’endroit d’où vous vous considérez comme originaire. In breve, si può ottenere il divorzio in Inghilterra se entrambi i coniugi vi hanno vissuto prima della separazione e uno dei due ancora vi vive, o se vi hai vissuto almeno 12 mesi (ridotti a 6 mesi qualora fossi anche ivi domiciliato) prima dell’inizio delle pratiche di divorzio. I concetti di “residenza abituale” e “domicilio” sono diversi rispetto a quelli applicati nell’ambito fiscale e riguardano invece il tuo centro di interesse e il luogo da cui ti consideri provenire. Pertanto, si può procedere al divorzio anche quando entrambe le parti siano domiciliate in Inghilterra.

If I get divorced here, how does the Court treat my assets?

In England, the starting point for the court is a 50-50 division of the assets accrued over the course of the marriage, unless there is a reason to deviate from this. The most common reason for departing from this is ‘needs’, especially if there are children. If there is more than sufficient to meet needs, then inherited assets, or assets accrued pre-marriage or post separation are generally ring-fenced, unless there has been significant co-mingling of these assets during the marriage.

Si je divorce ici, comment le tribunal traite-t-il mon patrimoine ?

En Angleterre, le tribunal part du principe qu’il faut répartir équitablement les biens accumulés durant le mariage, à moins qu’il n’existe un motif de déroger à la régle. Le motif de dérogation le plus courant est lié aux besoins , surtout s’il y a des enfants. Si les besoins sont suffisamment couverts, le patrimoine hérité ou le patrimoine acquis avant le mariage ou après la séparation est généralement écarté, sauf si ces biens ont été regroupés de façon significative pendant le mariage.

In Inghilterra, il tribunale di base ripartisce in parti uguali, con una divisione di tipo 50-50, i beni acquisiti in costanza di matrimonio, a meno che vi siano ragioni per derogare alla norma. Il motivo più comune

If I get divorced here, am I supposed to pay/receive maintenance?

In England the parent with whom the children live for most of their time will receive child maintenance from the other parent until each child reaches the age of 18.

Spousal maintenance will depend on a variety of factors such as the duration of the marriage, age, earning capacity and so on. A spouse who has not worked for most of a long marriage could potentially receive maintenance from the other spouse for the rest of their life. This maintenance can be capitalised at any stage if there are sufficient funds, and the court also has power to make orders transferring part of one spouse’s pension to the other. If both spouses are working at the time of separation and are earning enough to support themselves, frequently no maintenance will be payable.

Si je divorce ici, suis-je censé(e) payer ou recevoir une pension alimentaire ?

En Angleterre, le parent avec lequel les enfants vivent la plupart du temps reçoit une pension alimentaire de l’autre parent jusqu’à ce que chaque enfant atteigne l’âge de 18 ans.

La pension alimentaire due au conjoint dépendra de divers facteurs tels que la durée du mariage, l’âge, les ressources ou revenus éventuels, etc. Un conjoint qui n’a pas travaillé pendant la majeure partie d’un mariage de longue durée pourrait éventuellement recevoir une pension alimentaire de l’autre conjoint pour le restant de ses jours.

Cette pension alimentaire peut être capitalisée à tout moment si les fonds sont suffisants, et le tribunal a également le pouvoir d’ordonner le transfert d’une partie de la pension d’un conjoint à l’autre. Si les deux conjoints travaillent au moment de la séparation et gagnent suffisamment pour subvenir à leurs besoins, il est fréquent qu’aucune pension alimentaire ne soit due.

In caso di divorzio in Inghilterra, dovrò ricevere/pagare le spese di mantenimento?

In Inghilterra, il genitore con cui i minori vivono la maggior parte del tempo riceve le spese per il loro mantenimento dall’altro genitore, fino al raggiungimento del diciottesimo anno di età dei minori stessi.

Il mantenimento del coniuge dipende da diversi fattori quali la durata del matrimonio, l’età, la capacità di guadagno e altro. Un coniuge che non abbia lavorato per la maggior parte della durata del matrimonio potrebbe potenzialmente ricevere il mantenimento dall’altro coniuge per il resto della sua vita. Il mantenimento può essere capitalizzato

in qualsiasi fase qualora ci siano fondi sufficienti. Il tribunale inoltre

ha il potere di ordinare il trasferimento di parte della pensione di un coniuge all’altro. Qualora entrambi i coniugi lavorino al momento della separazione e guadagnino abbastanza da essere autosufficienti, in genere non è prevista alcuna spesa di mantenimento.

Would the outcome be different if prior to our wedding we had signed a document about how to hold our assets?

Pre-Nuptial Agreements are not currently binding in England; that said, if they have been entered into sufficiently in advance of the marriage, both parties have received independent legal advice and there has been financial disclosure, they will be very persuasive to the court. The court will consider whether the terms are ‘fair’; even if they are found to be unfair, the fact that there was an agreement is likely to result in a financial outcome that is considerably lower than would have otherwise been the case.

Le résultat serait-il différent si, avant notre mariage, nous avions signé un document sur la manière de détenir notre patrimoine?

Les contrats prénuptiaux ne font actuellement pas jurisprudence en Angleterre. Cela dit, s’ils ont été conclus suffisamment longtemps avant le mariage, si les deux parties ont reçu un avis juridique indépendant et qu’il y a eu divulgation de renseignements financiers, ils auront une valeur persuasive pour le tribunal. Le tribunal déterminera si les conditions sont équitables. Même si elles sont jugées abusives, le fait qu’il y ait eu un contrat est susceptible d’entraîner une compensation financière considérablement inférieure à ce qu’elle aurait été autrement.

Sarebbe diverso se prima del matrimonio avessimo firmato undocumento che disciplina gli aspetti patrimoniali?

I contratti prematrimoniali non sono attualmente vincolanti in Inghilterra.
