Away from the turmoil in the political arena and economic markets caused by Brexit, in this edition of Recruitment Watch, we have instead highlighted some of the other most topical issues facing the Recruitment Sector, front and centre of which is the fast approaching implementation of IR35. The government has confirmed that, despite industry calls for a delay in bringing in the new rules, the current intention is that changes will take effect from 6 April 2020. Our tax experts offer advice on what the changes entail and how businesses in the recruitment sector can be best placed to react when the draft legislation is published.

Over one year on since the implementation of the GDPR, our data protection experts offer practical advice on what businesses in the recruitment services sector can do to limit the scope of their responses to Subject Access Requests and even, in certain cases, to argue they have no obligation to comply.

Mishcon de Reya recently advised Impellam Group PLC on the acquisition of Flexy Corporation Limited, highlighting the increasing use of AI in the recruitment sector. Our corporate team consider some of the high profile pitfalls that have occurred upon the implementation of some AI solutions in the sector.

We also look at the recent Supreme Court decision in the case of Egon Zehnder v Tillman, the first employment restrictive covenant case to be considered by the highest court in the land for over a century and consider what it will mean for employers drafting restrictive covenants into their employment contracts.
