The High Court of England and Wales has ruled that legislation which allows intelligence services to indiscriminately collect UK citizens’ data is compatible with the European Convention on Human Rights – despite the government’s recent disclosure that MI5 abused its powers under the UK law.
Jon Baines at Mishcon de Reya in London said a key takeaway from the judgment is the importance of the oversight that the Investigatory Powers Commissioner has of surveillance powers. “[W]e can expect even more attention to be given to [the commissioner] and his office in the future,” Baines said.
