What is your digital legacy? And how can you protect it? In this short film, part of the Mishcon Thinks series, Partner and Head of the Trusts and Estates Disputes group, Mark Keenan, discusses these issues with Michael Hayman MBE of Seven Hills.
It is clear that the law has not kept pace with technological developments – in this film Mark highlights the issues this raises and how a lack of understanding of this particular area is symptomatic of a widespread reticence to engage in making wills and discussing wishes with loved ones.
BBC News - Who owns digital data when you die?
Earlier this year, we commissioned YouGov to conduct some research on digital legacy. The survey revealed widespread confusion over who owns online accounts, including social media and online wallets such as PayPal, after death - leaving people vulnerable to losing control over their online property. It also showed that millions of people accept terms and conditions without reading or fully understanding their meaning, despite them being binding legal documents. See below some key findings and read the full survey findings here.
