Article 50 Legal Challenge

Today at the Supreme Court the Government is appealing the ruling handed down at the High Court on Thursday 3 November that the Secretary of State does not have the power under the prerogative to give notice pursuant to Article 50 of the Treaty on European Union.

Mrs Miller, who is now the Respondent to the Government's appeal, maintains that the triggering of Article 50 is unlawful without statutory authorisation – that is authorisation by an Act of Parliament. The case can be viewed here and a one page summary is available here.
