David Rose on UK's ratification of The Unified Patent Court Agreement

Intellectual Property Partner David Rose was recently quoted in LexisNexis on the UK's ratification of the Unified Patent Court Agreement  – an international treaty by which the international court will oversee patent disputes between contracting states. The article, 'Brexit and German challenge are 'hurdles' for the creation of a Unified Patent Court', explores the challenges that could hurt the creation of the Court.

David said "even before the uncertainty presented by Brexit and the German challenge, many anticipated that patentees would mainly look to opt their existing European patents out of the jurisdiction of the UPC".

He recommends patentees "continue to monitor the situation in Germany so that they are ready to act when they need to" - indicating that change could happen at any time. A "wait and see" approach, David explains, is the best strategy as negotiations stand.
