Article 50 Legal Challenge

On behalf of the firm's client, Gina Miller, Mishcon de Reya has today filed at the Supreme Court Mrs Miller's response to the Government's appeal of the ruling handed down at the High Court on Thursday 3 November.  The ruling was that the Secretary of State does not have the power under the prerogative to give notice pursuant to Article 50 of the Treaty on European Union.

Mrs Miller, who is now the Respondent to the Government's appeal, maintains that the triggering of Article 50 is unlawful without statutory authorisation – that is authorisation by an Act of Parliament.
