An overhaul of IP rights

On 22 November 2016, World Intellectual Property Review published analysis of the European Commission's proposals to modernise copyright law (discussed in our October 2016 edition of Inside IP).  Jeremy Hertzog provides extensive commentary in the article, in particular, on the competing interests at stake in developing copyright policy.  Jeremy identifies a number of issues in relation to key proposals in the copyright package, including the proposed new related right for press publishers and proposals intended to address the 'value gap' between user-upload platforms and rights owners.  He also comments on the potential impact of Brexit on the extent to which the UK will be obliged to implement the proposals, and the timings involved.
