Tax

Multi-disciplinary practice for converging worlds of tax

More and more, we recognise how the corporate, business and personal taxation needs of our clients overlap. For this reason, our tax practice is deliberately broad, with experts in all aspects of corporate M&A and restructuring; real estate; tax disputes and investigations; employment incentives and rewards; VAT; personal tax and cross border issues, for companies, funds and individuals.

Our business and personal tax groups work together to provide comprehensive, seamless and co-ordinated tax advice to our clients, and what we do is both transactional and advisory.

Besides the full range of non-contentious tax issues, we are one of a small number of tax practices that also advises on tax investigations and litigation. As a result, our tax offering is unmatched by almost all of our competitors.

Increasingly tax is a political issue too, which has led to increased levels of scrutiny and transparency, and national and international regulatory and reporting changes. To navigate these complexities, we work alongside our clients' existing teams of accountants, bankers, asset managers, trustees and family offices, devising and implementing the most robust and appropriate national and international tax strategies, legal structures and operational frameworks.

A lot of our work has an international dimension. We have lawyers qualified in multiple jurisdictions, who know how to work with multinational corporate groups, cross-border investment structures, multi-jurisdictional incentive arrangements, and international families and their corporate structures. In each case our lawyers provide in-depth advice on tax, structuring, regulatory, investment and corporate issues: in short, strategic, commercial and sensitive tax advice that protects our clients' interests.

Tax, and specifically the payment of tax, affects every business and individual. Our team has direct experience of working within HMRC and can help you reach a satisfactory agreement - for you or your business - as well as helping you to build a solid working relationship with HMRC going forward.

We have experience of taking matters through the whole court system including and up to the Court of Justice of the European Union.

Tax Disputes & Investigations

Our Charities Group has cross-departmental expertise to advise on all aspects of the law enabling charities and not for profit organisations to operate more effectively and commercially in pursuit of their objectives.

Our multi-discipline Corporate Real Estate team is made up of lawyers from our Corporate, Real Estate and Tax departments, all used to working closely with property clients on a wide variety of matters - including acquisitions, disposals, joint ventures and re-organisations.

Our specialist estate administration and probate lawyers bring the experience and expertise that families, executors, beneficiaries and trustees depend on following a death. It is often complex, high-profile and multi-jurisdictional work.

A major focus of Mishcon de Reya's business involves acting for ultra-high net worth families, family offices and entrepreneurs. Increasingly the firm is called upon to sit alongside owners or principals of a family enterprise to guide and assist them in addressing all the issues which they face.

We have decades of experience looking after HNW clients. Our response is always the highest level of bespoke services, in particular our ability to navigate Home Office processes, to overturn the latter’s decisions via negotiation, and to avoid protracted and costly litigation.

Immigration

We work hard to ensure we understand our clients' businesses and work with them to design and implement remuneration and employee incentive plans that are right for their businesses. We identify the financial metrics against which an incentives plan should be measured then structure the incentive strategically to drive the behaviours that the employer wants to achieve, designing arrangements that are simple, focused and effective.

Incentives and Remuneration

We have the largest dedicated Recruitment Services Group in the UK, including specialists in regulatory, litigation, employment and corporate law. We have acted at the highest level for organisations, individuals and teams in this sector for over 20 years.

The right corporate structure is invaluable to a business, which is why our cross-departmental team can deliver the full range of restructurings and reorganisations for both UK and cross border organisations.

We work closely with tax advisers who may have the expertise to structure the reorganisation from a tax perspective but require our expertise to advise on all legal aspects and to document and implement the reorganisation.

Our clients with business interests and personal wealth in the US and the UK are required to navigate two complex and very different tax systems. Successful wealth planning for such clients requires the lead advisor to be "ambidextrous" in that they understand the tax treatment of a proposed transaction in both countries simultaneously. The wealth planning frameworks and structures we devise are always bespoke and tailored to each specific situation. They can be domestic or international solutions, deploying a combination of trusts, foundations, corporate entities and other vehicles. They allow for asset diversification, flexible succession, tax and beneficiary planning. All to protect your long-term financial interests properly and, more importantly, those of your family.
