Richard Gerstein heads our Professional Negligence team. He has spent many years advising banks, businesses and private individuals on claims against surveyors, solicitors, accountants, construction professionals and financial advisers. Richard spent much of the 1990’s advising on claims which arose out of the late 1980’s recession and is now seeing history repeat itself.

In addition, Richard has a wealth of experience in claims and disputes in the Technology and Construction Courts and in arbitration and adjudication proceedings, acting for a variety of owners, developers, specialist subcontractors and consultants.

Richard is a Fellow of the Chartered Institute of Arbitrators and a Member of the Professional Negligence Lawyers' Association, the Society of Construction Law and the Adjudication Society.

Key Experience

Advising a property developer in respect of a claim against solicitors and counsel where the latter two had advised that proceedings should be taken all the way to a High Court trial (doomed advice from the start because the solicitors and counsel had advised wrongly on the law)
Acting on a claim against solicitors who gave wrong advice in relation to a case in the Court of Appeal which led to a valid appeal being struck out for procedural reasons
Advising two Italian banks on a dispute with the beneficiary of performance and advance payment bonds in relation to a development project in Russia
Acting for the successful architect challenging jurisdiction in Heifer v Christiansen.
