Tamasin Perkins, a solicitor at Mishcon de Reya Solicitors, explains why and when to challenge a will.
Legacies are an important source of income for charities and £1.8bn is bequeathed to voluntary organisations every year. Many charities hope to receive a legacy under a will but, on the person’s death, are told they are to receive nothing. For example, a will benefiting a family member, friend or carer and excluding the charity may have been made shortly before death and/or in suspicious circumstances. Many such wills turn out to be entirely proper and follow a change of heart by the testator – but sometimes there is cause for concern.
